This time we will look particularly at a minimum guarantees that the state establishes in Article 2 of the Constitution
" Article 2 .- State duties. is the duty of the State guarantee to the inhabitants of the Republic
Life: the state is organized so that the person is one of the most important, as this would not exist without people who comprise it, and therefore obligated to protect the lives of the person as indicated from the preamble of the Constitution which states:
"CALLING ON THE NAME OF GOD
We, the representatives of the people of Guatemala, freely and democratically elected. Assembly meeting in Constituent, to organize legally and politically to the State, affirming the primacy of the human person as subject and purpose of social order ... ".
Furthermore, in Article 3 of the same Act provides protection to life and safety even from before the physical birth of the person, so our security is guaranteed by law of the unborn.
" Article 3 .- The right to life. The state guarantees and protects human life from conception .... "
also Article 1 of the Civil Code states: "... .. to the unborn is considered born for all that he favors ....".
Considering the foregoing, we conclude that the state mandated by law is required to ensure life under any circumstances, regardless of race, social or economic status, marital status, age etc.
